The Right to Work Checking Service is secure and free to use. It was launched in April 2019, however until now, employers have still needed to request paper documents alongside using the service. The changes will mean that employers can use the online service to demonstrate they conducted the necessary right to work checks on migrants and avoid a penalty if they are found to be employing illegal workers.
It is important to note however, that the Employer Checking Service is not applicable to all cases. Employers can use the service for those with immigration status that can be checked online; however, it is not yet available for checks against UK nationals and those with immigration status whose details are not online. Employers need to ensure their organisation is compliant with the Code of Practice, as those in breach could potentially face fines of up to £20,000 per illegal worker.
